October 22: We settled the DP case a couple of weeks ago.  CVUSD showed that even a cold peace does not interest them: they promptly sent a letter accusing me of sexually harassing their employees at school board meetings.  I will post it presently for your entertainment.  They’ve done this before to quite a few others.  Stephen knows from this and other things that they are still intent on hurting us.  In other news, I have been appointed to the State Senate Task Force on Autism, “the Education and Employment Workgroup, High Functioning and Asperger subgroup.”  Jaimie’s Non-Public School (NPS) should be certified shortly after December 3rd, when the state comes by.  Was at Advisory Council to OAH today, going to Sacramento tomorrow for the Advisory Council on Special Education and legislators.

August 21:  To the astonishment of all, they picked Charles Dickie, so a petition for special election is likely, but not certain as it was for the favored candidates.  We have also retained Drew Massey of Adams and Associates for the legal stuff.  I’ve already worked with Drew helping one of his clients.  Also heard from the investigator assigned at USDOE to investigate the FERPA complaint, so the wheels are turning.

July 20: Having broken his head in May, Bill Klein resigned from the board effective July 1.  The board decided July 9 to pick a replacement rather than hold an election, no doubt expecting to pick someone to their own liking. None of us realized that it takes only 1.5% of the voters to petition for an election, but we all realize it now, and an election seems certain.  Public interviews of all applicants, including me, on the 13th, and they pick on the 20th.

July 1: Stephen and I met today with Wayne Joseph, the new Interim Supt.  I’ve heard nothing but good things about him.  Whatever else, he does come with a working set of ears, unlike his predecessor.  “Drive out the scoffer and contention will go out, even strife and dishonor will cease” (Prov. 22:10).  Who knows?  Maybe now we can work it out.  I still need to submit the FERPA complaint, in part because some judges are ruling wrong on access to records, and it would be good if FCPO could get OAH clear on what the law is on this crucial matter.  But if the problem with CVUSD could just go away, that would be good for all.

June 30:  Got letter from CVUSD lawyer rebuffing my FERPA demand letter and suggesting that I have them explain to FPCO how right they are.  My mama taught none of her kids to take advice like that from opposing counsel, so I’ve pulled my FERPA complaint together as they advised me to.  Hopefully we can get all this settled before the hearing set for Aug 25th.  If not, it’s off to the district court, for which I seem to have someone lined up if necessary.  For now, OAH denied CVUSD’s motion to quash my subpoena, without prejudice.

May 6th: Spent day in Sacramento with CAPCA talking with legislators.  Testified at hearing on SB1538, which is to protect kids against abuse, after which CDE testified against it.  They explained that they can be trusted to investigate complaints and make sure this doesn’t happen – except that it does, because they don’t.  This authorizes anyone reading this, especially in the legislature, to access any records needed to examine CDE’s “investigation” of complaints S-0487-07/08, S-0521-07/08, and S-0663-07/08.  I will sign any required releases.

The Asperger Kid Flies over the Cuckoo’s Nest

Amended Due Process Complaint (4/17/2009)

Motion for Summary Adjudication (8/4/2009)

Summarizes district’s behavior from their own documents, and applies the law

We refused to have him drugged at their insistence, so on March 27th, 2007, Chino Valley Unified School District (CVUSD) in Southern California pretended that my Asperger son was suicidal and had the police drag him out of our home to a mental hospital for three days, so traumatized that he has been unable to get any schooling since.  They didn’t much like coughing up the paperwork that proved they knew he wasn’t suicidal.  He will never be able now to graduate from high school.

We’ve had IEP meetings, we’ve written to the board members and publicly addressed them, and now we’re on our way to a Due Process hearing.  I want to find others like us for mutual help.

We settled our Due Process case, got some essentials but no divorce, and district wants to fight some more, more than I expected.

The stupid things I’ve done and the cruel and stupid things they’ve done these two years make it a book worth writing, which should be useful to many.  I did not know that Special Education would become a way of life!
